There are no actions, suits or proceedings pending or threatened. against Seller or the property, affecting any portion of the Property, before any judicial tribunal or government agency dept. or instrumentality A contribution action, is pending under CERCLA by parties sued by US EPA for the Lusher St. plume. The matter is  pending in US District Court for the Northern District of Indiana, under Case No. 3:18-cv-00506-JD-MGG. The litigation has been stayed indefinitely by the Court, unless and until the Plaintiffs in this litigation actually perform any  remediation of lusher street plume. At this time there is no indication that the plaintiffs have taken any action. Separately, US EPA issued a special notice letter to Atlas die LLC now Flex Dies, LLC on Feb. 2, 2015 regarding a potential enforcement action based on the same facts that were alleged in the contribution action above. EPA submitted a proposed Consent Decree to Flex Dies in 2023 but stay any response by Atlas Die until October.
